Terms of Service

These Terms of Service ("Terms") govern your access to and use of SJ Monitor (the "Service"), operated by Sally Jo LLC ("Sally Jo," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SJ Monitor is a website, server, and infrastructure monitoring service. We attempt to check the targets you configure and to notify you of changes in their status. The Service is provided on an "as is" and "as available" basis.

2. Your account

  • You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
  • You must be at least 16, or the age of majority in your jurisdiction.
  • For team accounts, the account owner is responsible for their team members' use of the Service.

3. Acceptable use

You agree that you will:

  • Only monitor systems you own or are explicitly authorized to monitor.
  • Not use the Service to attack, overload, probe, scrape, or disrupt any system (for example, as a denial-of-service tool), and you will respect the minimum check intervals we enforce.
  • Not use the Service for any unlawful, infringing, deceptive, or abusive purpose, or to store or transmit malicious code.
  • Not attempt to breach or circumvent the Service's security or to access other customers' data.

We may suspend or terminate accounts that violate this section.

4. Plans, billing, and the free plan

  • The free plan is for personal, non-commercial use only.
  • Paid plans are billed in advance, monthly or annually, through our payment processor (Stripe), or by manual invoice for accounts we bill directly. Annual plans are discounted.
  • Fees are non-refundable except where required by law. You may cancel at any time; access continues through the end of the paid period.
  • We may change plans, limits, and pricing on a prospective basis with notice.

5. No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, timely, or secure, or that it will detect, report, or alert on any or all outages, downtime, errors, or other events. Monitoring may produce false positives, false negatives, missed checks, and delayed, inaccurate, or undelivered alerts. The Service is not a substitute for your own redundancy, backups, and operational safeguards.

6. Limitation of liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY WILL SALLY JO LLC, ITS OWNERS, EMPLOYEES, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND — including any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business — ARISING OUT OF OR RELATED TO THE SERVICE FOR ANY REASON, including, without limitation:

  • any failure to detect, report, or alert on downtime, an outage, or any other event;
  • any delayed, missed, or undelivered alert, or any false alert;
  • any interruption, inaccuracy, or error in the Service;

EVEN IF SALLY JO LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALLY JO LLC'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $0 FOR FREE-PLAN USERS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in those cases our liability is limited to the maximum extent permitted by law.

7. Indemnification

You will indemnify and hold harmless Sally Jo LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the targets or content you configure, or your violation of these Terms.

8. Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Service. You may stop using the Service and delete your account at any time.

9. Changes to these Terms

We may update these Terms; material changes will be posted here with a new "Last updated" date. Your continued use of the Service after changes take effect means you accept them.

10. Governing law & venue

These Terms are governed by the laws of the State of Indiana and applicable United States federal law, without regard to conflict-of-laws rules. You agree that the exclusive venue and jurisdiction for any dispute, claim, or proceeding arising out of or relating to these Terms or the Service shall be the state and federal courts located in Porter County, Indiana, and you consent to the personal jurisdiction of those courts.
